When is guidance useful?

An application for a permit must meet many conditions. It is not inconceivable that you will receive detailed questions and comments from the government that you do not know how to answer. We do not shy away from this: you have the duty to comply with all legal regulations, but not more than is necessary.

  • For new permit applications for your business activities
  • In the case of updates or changes to existing permits
  • Regarding permit regulations that you are unsure about whether they are appropriate
  • In case of conflicting or impossible requirements in a concept permit
  • If you are unsure whether you need a permit at all

Our approach

  1. 01

    Preliminary research and scope

We assess which activities require a permit and which fall under the general rules of the BAL. Sometimes no permit is required, but a notification is sufficient.

  2. 02

    Preparing the application

We prepare the application with all the necessary supporting documentation: technical descriptions, risk analyses, environmental studies and related reports.

  3. 03

    Examination of the concept permit

Before drawing up the plan, we check that the concept permit does not contain any regulations that are not permitted or that it contains contradictory requirements. The document must be workable, not more or less than necessary.

  4. 04

Guidance in consultation with the competent authority

In case of detailed questions or disputes with the competent authority, we will step in to provide the correct arguments.

With or without a permit?

Not every activity is subject to a permit requirement. For many companies, the general rules of the Environmental Activities Decision (BAL) apply and a permit is not required. We will assess that before you embark on a course of action that may not be necessary.

Frequently asked questions

Questions about this subject

How long does a permit application under the Environmental Code take?

The regular procedure takes eight weeks, with a possible extension of six weeks. For more complex applications, the extended procedure of six months applies, with the possibility of extension as well. We help plan and signal in a timely manner if the procedure is at risk of being delayed.

Can I deviate from standard regulations while remaining motivated?

Yes, often enough. Standard requirements are not absolute. If you can come up with an equivalent or better solution, there is room for that in consultation with the competent authority. We help you prepare that justification.

What if I don't agree with the regulations in my license?

You can submit your views during the procedure and appeal the final permit. More importantly, we ensure that the preliminary work is done properly so that the regulations are in order from the start. In the event of unexpected requirements at the end of the procedure, we can guide you through the appeal and appeal process.
